Terms and Conditions

The following terms and conditions stated below will act as a legal agreement between you and RIDEJOYFUL, LLC, a Florida based LLC. PLEASE READ THE ENTIRE AGREEMENT BEFORE USING THE RIDEJOYFUL, LLC APPLICATION OR SERVICES.

Your use of the RIDEJOYFUL, LLC application or services constitutes your agreement and understanding to be bound by these Terms and serve as a contract between you and RIDEJOYFUL, LLC. If you are not in agreement with these Terms you are not granted access to the RIDEJOYFUL, LLC apps or services. RIDEJOYFUL, LLC reserves the right to cancel this agreement at any time for any reason.

RIDEJOYFUL, LLC will from time-to-time update or edit this term. Any revisions of these terms will be posted to the agreement on the RIDEJOYFUL, LLC website (ridejoyful.com) and shall supersede any previous terms or conditions.

RIDEJOYFUL, LLC DOES NOT PROVIDE TRANSPORTATION AND IS NOT A TRANSPORTATION COMPANY. RIDEJOYFUL, LLC is an App that provides a service consisting of a web-based platform where a person seeking transportation can be linked to a third-party DRIVER offering a ride. Through the RIDEJOYFUL, LLC App a RIDER can request and schedule transportation as well as pay for said transportation and the third-party DRIVER can accept the request and be paid for supplying the ride. You acknowledge that the transportation provide to a RIDER is by an independent third party DRIVER that is in no way employed by or controlled by RIDEJOYFUL, LLC.

Upon acceptance and compliance of the entire terms and conditions described herein, RIDEJOYFUL, LLC shall grant you a non-exclusive, revocable, limited license to access and use the RIDEJOYFUL, LLC app on your computer or personal mobile device for personal, non-commercial use limited to your use of our service. 

You are not entitled to remove, reproduce, modify, distribute, lease, sell, resell, transfer, license, display or otherwise use the service except as permitted by this agreement. You may not use any information pertaining to or derived from RIDEJOYFUL, LLC apps for any purpose other than using the service unless written permission is expressly granted. All rights and services therein will remain the sole property of RIDEJOYFUL, LLC. These terms or your use of service do not entitle you to any rights related to service except for the limited license granted by this agreement. 

To become a User of the RIDEJOYFUL, LLC app you must register as a RIDER through the RIDEJOYFUL, LLC website (https://www.ridejoyful.com). You must create a RIDER account and attest that you are at least 18 years old. To become a DRIVER of the RIDEJOYFUL, LLC app you must register as a DRIVER through the RIDEJOYFUL, LLC website (https://www.ridejoyful.com). You must create a DRIVER account and attest that you are at least 21 years old. You must provide ALL information requested on the RIDER or DRIVER application to be granted access to the service. You must update and keep current all information including but not limited to payment information on your account. You will be solely responsible for all activity on your account including secrecy and privacy of account information and security passwords. This service is not available for persons under 18 years of age. Anyone under the age of 18 years old seeking transportation must be accompanied by a person of legal age listed as an account holder. You may be asked to provide proof of identity before services are rendered. If you do not comply you may be denied service.

This account is non-transferable. All applicable conditions and laws must always be complied with. Including but not limited to the use of service for only lawful purposes. You may not use this service to cause inconvenience, annoyance, property damage or any other acts deemed to be intolerable to any person or property whether related to this service or not. 

When creating a RIDER account, you agree to receiving communication from RIDEJOYFUL, LLC whether for use of services requested or for survey or promotional reasons. This communication may be through text messages, email, or phone. 

For use of RIDEJOYFUL, LLC services, the RIDER must maintain their own data network access. If any text or data rates apply, they are the sole responsibility of the RIDER and RIDEJOYFUL, LLC is not liable for any charges to the RIDER. RIDEJOYFUL, LLC will not be held liable for any failures of communications whether on the RIDEJOYFUL, LLC service site or on the RIDER's portion of communication.

Upon request for transportation, the RIDER will be quoted the estimated applicable fare for the ride predetermined and agreed to by the third-party DRIVER. By proceeding with the request, the RIDER agrees to the estimated fare. Once the ride is complete the DRIVER will initiate the payment process using the actual calculated fare. The payment will be collected by RIDEJOYFUL, LLC on behalf of the third-party DRIVER through the payment method provided by the RIDER on their RIDEJOYFUL, LLC account. All payments are due and payable upon completion of the requested ride. All charges are final and non-refundable unless deemed otherwise by RIDEJOYFUL, LLC. All cancellations requesting a ride must occur before the third-party DRIVER arrives at the requested pick-up point. A cancellation fee for late cancellation will occur in the event a ride is declined by RIDER.

In the event that you cause any damages, or extra cleaning it is necessary to a third party's vehicle, other than what is considered normal wear and use by you, you agree that payment will be facilitated through the payment method listed on your account for this damage or cleaning. Excess damage will be determined by RIDEJOYFUL, LLC at the DRIVER's request, and you will be notified of any charges related to this damage. 

DRIVERS:
Ridejoyful, LLC., DRIVERs must be 21 years old or older. DRIVER needs 3 years of U.S. driving experience. You must have a valid U.S. DRIVER’s license, vehicle registration, auto insurance and a clean driving record. Ridejoyful. LLC., background check the last seven years of the DRIVER’s criminal and driving history. DRIVER’s cannot have DUI or drug-related offenses, been involved in any fatal accidents or a history of reckless driving.

VEHICLE REQUIREMENTS:
The Vehicle must be no older than 15 years and must have four doors. The Vehicle must be able to open and close from both inside and outside of the car. Passengers must be able to unlock and lock their own doors, and there must be at least five seat belts. The DRIVER cannot use a rental vehicle, a salvaged, rebuilt, or reconstructed vehicle. The Vehicle should be in good condition – meaning; Engine, suspension, steering and brakes must be working properly. Air conditioning and heat should be working properly. All the lights should function – including high- and low-beam headlights, turn signals, brake lights, and reverse lights. The tires must have sufficient tread, the wipers and horn work, and the front seats move forward and backward. Windows and mirrors cannot have cracks, and windows need to work right. Tailpipe and mufflers should be within the state standards and should not be modified. The vehicle cannot have body damage or dents. All vehicles must pass an inspection.

ALL OF RIDEJOYFUL, LLC SERVICES ARE OFFERED ON AN AS AVAILABLE SERVICE. RIDEJOYFUL, LLC CLAIMS NO WARRANTIES, IMPLIED OR OTHERWISE, UNLESS ADDRESSED DIRECTLY IN THESE TERMS AND CONDITION. RIDEJOYFUL, LLC DOES NOT GUARANTEE THE AVAILABILITY, RELIABILITY, OR QUALITY OF SERVICE PROVIDED. RIDEJOYFUL, LLC DOES NOT GUARANTEE AGAINST SERVICE INTERRUPTION OR TIMELINESS OF THE RIDE. ANY AND ALL RISK LIES SOLELY WITH YOU AS THE RIDER/RIDER OF THIS SERVICE AS ALLOWED BY LAW.

RIDEJOYFUL, LLC SHALL NOT BE LIABLE FOR ANY DAMAGES WHETHER DIRECT, INDIRECT, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL. THIS INCLUDES PERSONAL INJURY, LOST REVENUE, OR PROPERTY DAMAGE RELATED TO DIRECTLY OR INDIRECTLY FROM THE USE OF RIDEJOYFUL, LLC SERVICES. FURTHERMORE, RIDEJOYFUL, LLC WILL NOT BE HELD LIABLE FOR ANY LOSS OR DAMAGE THAT MAY ARISE AS A RESULT FROM THE TRANSACTION BETWEEN YOU AND THE THIRD-PARTY DRIVER. RIDEJOYFUL, LLC DOES NOT IMPLY THAT THIRD PARTY DRIVERS HAVE ANY SPECIAL QUALIFICATIONS TO PROVIDE TRANSPORTATION OTHER THAN A VALID AND UP-TO-DATE: PERSONAL AUTO INSURANCE, VEHICLE REGISTRATION AND A DRIVER'S LICENSE IN THE STATE OF FLORIDA OR THE STATE WHERE THE DRIVER IS OPERATING IN THE U.S.A. RIDEJOYFUL, LLC IN NO WAY WARRANTS THE PERFORMANCE OF THE THIRD-PARTY DRIVER.

RIDESHARE INSURANCE:  We strongly advise you to get rideshare insurance. Ridejoyful, LLC., has insurance that covers Period 3: When the passenger is in the vehicle and the ride is in progress only. The driver’s vehicle is not covered.
Rideshare insurance is a type of insurance coverage designed for individuals who drive for ridesharing platforms like Uber or Lyft. It's not a legal requirement in all places, but it's often a good idea for rideshare drivers to have this coverage for several reasons:

Personal Auto Insurance Exclusions: Personal auto insurance policies typically exclude coverage when the vehicle is used for commercial purposes. Since rideshare driving is considered a commercial activity, your personal insurance may not cover you during this time.

Coverage Gaps: Ridesharing companies typically provide different levels of coverage depending on the stage of the ride (e.g., waiting for a passenger, in route to pick up a passenger, or during the ride). There may be gaps in coverage that could leave you financially vulnerable.

Legal Requirements: In some regions, rideshare drivers may be legally required to have specific insurance coverage that meets certain standards.

YOU ACKNOWLEDGE THAT THOUGH RIDEJOYFUL, LLC PERFORMS A RAMDON DRUG SCREENING OF A DRIVER, RIDEJOYFUL, LLC WILL NOT BE HELD LIABLE FOR ANY TYPE OF DRUG USE OR ABUSE BY THE THIRD-PARTY DRIVER POST INTERVIEW.

BECAUSE OF ACCESSIBILITY REQUIREMENTS RIDEJOYFUL, LLC MAY REFER YOU TO ANOTHER SERVICE THAT PROVIDES THE APPROPRIATE VEHICLE ACCESSIBILITY REQUIREMENTS. RIDEJOYFUL, LLC IS IN NO WAY RESPONSIBLE OR LIABLE IN ANY WAY FOR ANY ACTIONS OR INCIDENT THAT OCCURS IF YOU USE THE REFERRED PROVIDER. 

FURTHERMORE, YOU AGREE TO HOLD HARMLESS AND INDEMNIFY RIDEJOYFUL, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, LIABILITIES AND EXPENSES ARISING OUT OF USE OF THE RIDEJOYFUL, LLC SERVICE.

You further agree that any claim or dispute arising from the use of RIDEJOYFUL, LLC services will be settled by binding arbitration between you and RIDEJOYFUL, LLC. You are hereby agreeing to waive your right to a trial by jury or to participate as a plaintiff in any class action proceeding.

These terms and conditions may not be assigned by you without the written permission of RIDEJOYFUL, LLC. RIDEJOYFUL, LLC may assign these terms without your consent to a subsidiary, or any entity deemed suitable by RIDEJOYFUL, LLC. These terms and conditions in no way represent any joint venture, partnership, or relationship between you and RIDEJOYFUL, LLC or the third-party DRIVER as a result of this agreement.
